Terms Of Service
Only the following conditions apply to all orders and sales through our web shop, by e-mail, by phone/fax or surface mail. Deviating clauses only apply if acknowledged by us in writing.
All products are made available as a download after payment is received. No physical goods are delivered. After payment has been received, the customer will promptly receive a confirmation mail containing the invoice (confirming the receipt of the payment) and the download link.
As soon as the order was properly sent, the customer will be shown a confirmation of the submission on the web page. The confirmation will also be sent to an email address provided by the customer. This confirmation of sumission does not constitute an acceptance of the order by us.
The customer is bound one week (7 days) by his order.
Right to withdraw from the contract: do not grant a right to withdraw from the contract after the software has been downloaded.Before the software has been downloaded, you have the right to withdraw from the contract for 14 days (and at least 5 working days, whichever is longer). It suffices to send the withdrawal notice in time. You will then be refunded the full amount, and the order will be cancelled and all access rights will be revoked.
All invoices and bills are in Euro. If advance payment is done from abroad, the customer needs to ensure that all charges are paid by the customer and we receive the full amount.
Technical support: Over the Ticket to resolve technical issues. Each purchase you are provided support for one live site only.
Upgrades and Bug fixes: As a subscriber, you will receive product upgrades and bug fixes.
You are authorized to make any necessary modifications to our extensions to fit your purposes. You may not, however, change or remove the copyright information from any file. Our software is protected under the GNU/GPL - please keep the copyright notices.
You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are property of holdysoftware.
Our products are provided “as is” without warranty of any kind, either expressed or implied. In no event shall holdysoftware be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.
Holdysoftware extensions will specify which version of Joomla! they are compatible with and are tested with only core Joomla functionality and core Joomla! modules, components and other said features. As such we cannot guarantee that the products will run with past or future versions of these CMS's nor can we guarantee that any of our products will work with any 3rd party extension developed for the Joomla! CMS. Please read the documentation and FAQ for each of our products for further information.
The Product: You will receive all the necessary down-loadable zipped files with each purchase.
Holdysoftware has the right to refuse support services for customers without a good standing account.
Holdysoftware reserves the right to change or modify these terms with no prior notice.
Documentation:
Each product includes extensive documentation. In the documentation, we provide the information you need for a successful launch. If you need additional information or assistance we are available via our support desk and our community forums.
Holdysoftware does not offer support for local installs. It is impossible for us to troubleshoot what we cannot see nor test.
Holdysoftware will not install server components because our software may be incompatible with old server configurations. Please contact your hosting provider to make adjustments.
Holdysoftware may require FTP and Joomla! super admin access. 'Netbase' will only work with FTP access and not with screen sharing software or 3rd party file management components that work inside of Joomla!. 'Netbase' retains the right to refuse support if this request is not met.
You can cancel your subscription at any point, meaning your subscription will not renew at the end of its current term. If you cancel your subscription, no additional charges will be made. You will maintain access to the content received while your subscription was active.
Canceling a subscription will not retroactively refund subscription payments and previously charged subscription fees cannot be prorated based on cancellation date.
